Terms and Conditions of Service

1. Fundamentals

PublishSEO operates an online marketplace facilitating the placement of articles and link-building opportunities on third-party websites through the PublishSEO platform. Customers of PublishSEO and individuals registering due to interest in our services are referred to as “Participants.”

2. Scope and General Provisions

PublishSEO provides its services exclusively under these Terms and Conditions (“Terms”). Any terms that differ from or contradict these Terms require the express written approval of PublishSEO.

3. Participants

Eligible Participants are individuals or legal entities, including legally competent partnerships engaged in commercial, independent, or freelance activities. Participants must be at least 18 years old and have full legal capacity.

By registering, Participants confirm they are acting as entrepreneurs under applicable commercial law and are fully capable of conducting business activities.

4. Registration

• Acceptance of these Terms is required to complete registration.
• Participants must provide accurate, current, and complete information.
• Each Participant is allowed only one registration.
• Unique access credentials will be issued during registration; Participants must keep them confidential.
• Registration forms a binding offer to use the platform. The contract is finalized upon PublishSEO’s confirmation and account activation.
• PublishSEO may reject or terminate any registration without stating reasons.
• Participants may update their data within their account.
• Participants agree to receive non-promotional, service-related notifications by email.

5. Contract Formation

Contracts via the PublishSEO platform can only be concluded in English. A Participant’s order (“booking request”) is binding but may be rejected by PublishSEO or by the operator of the target website. A contract is formed once the target website operator accepts the booking request, after which the operator is obligated to fulfill the requested service.

6. Payment Processing

Payments for PublishSEO services are processed online via secure payment gateways such as Stripe. Credit balances or prepaid top-ups are not permitted.

If a booking request is rejected, a refund will be issued to the original payment method within five (5) business days. A cancellation invoice can be provided upon request.

7. Participant Responsibilities

Participants are solely responsible for the accuracy and legality of content they provide and agree not to transmit content that violates applicable law or third-party rights. Participants shall indemnify PublishSEO against any claims arising from such violations. Participants must promptly update any changes to their registration data.

8. PublishSEO Responsibilities

PublishSEO is not liable for the content, operation, or availability of third-party websites. While we strive to maintain a reliable service, uninterrupted access is not guaranteed. We reserve the right to modify or discontinue features at any time.

9. Limitation of Liability

PublishSEO’s liability is limited to damages caused intentionally or by gross negligence. Claims of slight negligence are excluded, except in cases involving personal injury. Liability for indirect or consequential damages, lost profits, unrealized savings, interest losses, and third-party claims is excluded.

10. Data Protection

PublishSEO complies with applicable data protection laws. By registering, Participants consent to the processing of their personal data for the execution and administration of services, in accordance with our Privacy Policy.

11. Amendments to Terms

PublishSEO may amend these Terms at any time. Updated Terms will be sent by email at least two weeks prior to taking effect. Failure to object within two weeks constitutes acceptance of the revised Terms.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of the United States. Any disputes shall be subject to the exclusive jurisdiction of the competent courts at the headquarters of Agile Fullstack LLC.

13. Refund Policy

• Refunds are issued only to the original payment method, PayPal, or Payoneer account.
• A full refund will be provided if a publication is rejected by the publisher (before accepting the guidelines) or by our team at any stage. Once guidelines are accepted by the publisher, funds remain locked until the publication goes live.
• No refunds are available after an order is delivered and publication link is accepted by advertiser.
• All refunds are subject to deduction of applicable online payment processing fees incurred during order placement.

13.1. Publisher Policy

• Publishers are responsible for keeping all published links live for the full duration specified in the agreement.
• Links must remain accessible to search engines and visitors without being hidden, no-indexed, or blocked by robots.txt.
• Content and links must not be altered, removed, or redirected during the agreed period.
• If a link is removed or the website becomes unavailable before the agreed duration, the publisher must either restore it promptly or provide an equivalent replacement approved by PublishSEO.
• If a publication is removed by the publisher at any point during the agreed duration, the publisher must issue a full refund of the order amount.
• Repeated violations may result in withholding payments, removal from the marketplace, or permanent suspension of the publisher’s account.

14. Severability

If any provision of these Terms is or becomes invalid, the remaining provisions remain effective. The invalid provision will be replaced with a valid one that closely reflects the original intent. This also applies to any regulatory gaps.

15. Contract Language

The contract language is English. In case of translation discrepancies, the English version prevails.
